Notice and documentation workflows help small employers deliver required communications consistently and maintain records supporting ICHRA administration. A defined process makes it easier to track what was prepared, delivered, received, and retained.

Before each plan year, the employer should identify the applicable notices, responsible parties, delivery methods, and relevant deadlines. Notices should reflect the current plan terms, including eligibility, allowance information, effective dates, and any actions employees may need to take. Model notices should be reviewed and adapted to the employer's specific plan.

Documentation may include governing plan documents, employee class and eligibility records, copies of notices, evidence of delivery, employee attestations or responses, and supporting information received from employees. Records should be organized by plan year and updated when plan terms or employee circumstances change.

When missing or inconsistent information affects a notice or administrative record, the matter should be addressed before the information is relied upon. Employees should receive clear instructions and sufficient time to provide any requested response or documentation.

Related matters may also be addressed in Employee Class Design, Plan-Year Tasks, and Missing Information.

Employers remain responsible for determining which notices and records are required, providing communications within applicable timelines, and maintaining appropriate documentation.
