Employee class design allows an employer to organize its workforce into permitted groups for ICHRA eligibility and allowance purposes. For small employers, a simple class structure is often easier to explain, administer, and maintain as workforce changes occur.
Classes should be based on employment distinctions permitted under applicable ICHRA rules, such as full-time or part-time status, salaried or hourly status, seasonal status, employees whose primary site of employment is in the same rating area, or coverage under a collective bargaining agreement. Classes should not be based on an employee's health condition, expected medical needs, or individual insurance choices.
Employees within the same class generally must be offered the ICHRA on the same terms, subject to permitted variations based on age or family size. If an employer offers an ICHRA to one class and a traditional group health plan to another, certain class structures may be subject to minimum-class-size requirements.
Class definitions, eligibility rules, and allowance methodology should be documented before the plan year begins and applied consistently. Workforce changes that affect an employee's class should be addressed in accordance with the governing plan documents and applicable effective-date rules.

Employers remain responsible for selecting permitted classes, documenting class definitions, and applying plan terms consistently.
