2027 ICHRA Renewal Checklist: What Employers Should Review Before January 1

A practical 2027 ICHRA renewal checklist covering employee coverage, affordability, enrollment deadlines, payroll, and compliance.

An employee's health insurance policy renews automatically for 2027. The employer assumes everything is in place. But the employee has been moved to a different insurer, the monthly premium has changed, and the administration system still contains the 2026 policy information.

The first January premium payment may now be directed to the wrong insurer.

This is one of the practical risks employers face when renewing a CHOICE Arrangement (ICHRA) for 2027.

For employers already offering an Individual Coverage Health Reimbursement Arrangement, annual renewal requires coordination between individual insurance policies, employer allowances, enrollment decisions, payroll, and coverage verification.

Several developments in the 2027 individual insurance market make that coordination particularly important.

What's Different for ICHRA Renewals in 2027?

Four developments deserve attention before the new coverage year.

Insurers proposed a median 15% premium increase

According to an August 3, 2026, analysis by KFF, ACA Marketplace insurers proposed a median premium increase of 15% for 2027 across publicly available filings nationwide.

These were proposed rate changes, not final approved premiums. Actual increases vary by insurer, state, rating area, and plan.

For ICHRA employers, changing premiums can affect employee contributions and the relationship between established allowances and the cost of available coverage.

Eleven insurer groups announced Marketplace exits

According to KFF's October 28, 2026, update, 11 insurers, grouped by parent company, had announced plans to exit ACA Marketplaces in some or all of the states where they currently offer coverage for 2027.

These announcements do not mean that 11 insurer groups are leaving the entire national individual market.

They do mean that some employees may need replacement coverage, potentially with different insurers, premiums, provider networks, and payment instructions.

Enhanced Premium Tax Credits have expired

The enhanced federal Premium Tax Credits expired at the end of 2025. Under the rules currently applicable to 2027, the general income eligibility ceiling of 400% of the federal poverty level applies again.

This matters when employees evaluate whether to accept an ICHRA or opt out and seek Marketplace financial assistance.

The 2027 affordability percentage is 10.22%

The IRS affordability percentage for 2027 is 10.22%, up from 9.96% in 2026.

Applicable Large Employers should review how the 2027 percentage and updated lowest-cost silver plan premiums affect their affordability calculations.

Together, these developments make renewal preparation especially important for employers whose employees obtain coverage across different carriers or states.

1. Identify Employees Affected by Carrier Exits or Plan Changes

Start with employees whose current individual policies may not continue unchanged into 2027.

A carrier may discontinue a plan, withdraw from a particular service area, or leave a state's individual market. An employee may receive an automatic reenrollment offer or need to select replacement coverage.

For a traditional individual insurance consumer, the immediate concern is maintaining suitable coverage.

For an ICHRA employer, there is an additional administrative consequence.

A replacement policy may have a different policy identifier, premium amount, insurer, and payment destination.

If the employer's administration records are not updated, January premium payment coordination and coverage substantiation may still reference the previous policy.

A practical renewal review should compare each affected employee's 2026 coverage with the confirmed 2027 policy information.

Particular attention should be given to employees whose carrier is exiting, whose plan is being discontinued, or whose automatic reenrollment places them in a different product.

This review also provides an opportunity to encourage employees to verify provider networks and prescription coverage before accepting a replacement plan.

2. Confirm Which Employees Need to Act Before December 15

In states that use HealthCare.gov, the 2027 Open Enrollment Period runs from November 1, 2026, through January 15, 2027.

December 15, 2026, is generally the deadline for selecting Marketplace coverage effective January 1, 2027.

State-based Marketplaces may have different deadlines.

Importantly, December 15 is not a universal deadline requiring every existing ICHRA participant to select a new plan. Some employees may be automatically reenrolled with January 1 coverage.

The employer's priority should be identifying employees who actually need to take action.

That includes employees whose plans are ending, those who want different coverage, and those whose automatic renewal status is uncertain.

Enrollment confirmation should also be distinguished from payment confirmation. A selected policy may require an initial premium payment before coverage becomes effective.

For employers with participants in multiple states, a single company-wide reminder may be insufficient. Employees need deadlines and instructions applicable to their coverage arrangements.

3. Recalculate Affordability Against Final 2027 Premiums

Many employers established their 2027 ICHRA allowances before the standard October 3 annual notice deadline.

At that point, final 2027 individual market premiums may not have been available in every rating area.

That creates an important question:

Does the allowance communicated for 2027 still produce the intended affordability result when measured against final 2027 premiums?

For Applicable Large Employers, generally those with at least 50 full-time employees including full-time equivalents, ICHRA affordability can affect compliance with the ACA employer shared responsibility provisions.

The calculation should account for applicable lowest-cost silver plan premiums, employee ages, relevant locations, the established allowance, and permissible affordability safe harbors.

The 2027 affordability percentage is 10.22%.

A recalculation does not automatically mean the employer should change its allowance.

Where an affordability concern is identified, any proposed amendment to an established arrangement must be evaluated against the plan terms, notice requirements, and applicable law.

The immediate value of recalculating is knowing where the arrangement stands before January and identifying potential issues early.

4. Update Premium Payment and Payroll Information

A 2027 renewal can change the amount an employee owes each month even when the employee keeps the same insurer.

A carrier change introduces another variable: where the premium must be paid.

Employers should reconcile confirmed 2027 policy information against their administration and payment records before January processing begins.

The review should cover premium amounts, policy identifiers, carrier information, payment destinations, employee responsibilities, and applicable payroll deductions.

What Happens When an Employee's Health Insurance Premium Changes Under ICHRA?

Employers using Section 125 arrangements should also review whether payroll deductions remain appropriate for the employee's coverage.

Marketplace individual insurance premiums cannot be paid through a Section 125 cafeteria plan on a pre-tax basis. Eligible off-Marketplace coverage may be treated differently under applicable rules.

ICHRA and Section 125 Cafeteria Plans

The objective is to ensure that the policy the employee actually holds in January matches the information used for payment coordination and payroll administration.

5. Verify 2027 Coverage Before Processing Benefits

A 2026 coverage record does not establish that the same policy remains effective in 2027.

ICHRA rules require reasonable substantiation procedures to establish qualifying individual health insurance coverage for participants and applicable covered dependents.

Annual coverage substantiation and substantiation of individual reimbursement requests are separate requirements.

For renewal, employers and administrators should focus on whether the employee has qualifying coverage for the new coverage period and whether the supporting records reflect the correct policy.

Consider an employee automatically reassigned to another insurer for January.

The previous policy may have been properly verified throughout 2026. That historical verification does not establish enrollment under the replacement policy.

Before processing applicable January benefits, administrators should obtain and review the necessary substantiation in accordance with the arrangement's procedures.

Unresolved coverage discrepancies should be investigated before they lead to incorrect benefit administration.

6. Revisit Opt-Out Decisions and Premium Tax Credit Eligibility

The expiration of enhanced Premium Tax Credits makes employee education especially relevant during the 2027 renewal period.

An employee generally cannot receive a Marketplace Premium Tax Credit while accepting an ICHRA.

If the ICHRA is unaffordable, the employee may be eligible for a Premium Tax Credit by opting out, provided all other eligibility requirements are satisfied.

But opting out does not guarantee financial assistance.

With the general 400% federal poverty level income ceiling again applicable for 2027, an employee whose household income exceeds that limit generally will not qualify for a Premium Tax Credit under current law, even if the ICHRA is unaffordable.

That distinction can materially affect an employee's decision.

Employers should ensure that participants understand their opt-out rights, the interaction between ICHRA and Marketplace assistance, and the importance of evaluating their own eligibility before making enrollment decisions.

Individual tax credit eligibility depends on household circumstances and should be reviewed using appropriate Marketplace resources or qualified tax guidance.

7. Prepare for Employees Whose Eligibility Changes on January 1

Renewal planning should extend beyond employees who remain in the same positions and locations.

A new hire may become eligible for the arrangement. An existing employee may move between employee classes, relocate, or experience a change affecting eligibility.

These changes can influence the applicable allowance, coverage options, enrollment opportunities, and required notices.

For example, an employee moving to a different state may encounter a different individual insurance market, with new carriers, plan availability, and premiums.

Employers should review anticipated January workforce changes with their administration partners and confirm that onboarding and eligibility procedures reflect the applicable ICHRA rules.

Special attention should be given to changes between employee classes because ICHRA class rules place restrictions on how employers structure coverage offerings.

A Reminder About the 90-Day ICHRA Notice

This checklist is intended for employers renewing an existing ICHRA.

Under the standard ICHRA annual notice rule, required notices generally must be provided at least 90 calendar days before the start of the plan year.

For a January 1, 2027, plan year, that deadline was October 3, 2026.

Different timing rules apply in certain circumstances, including some newly eligible participants and qualifying newly established employers.

Employers should confirm that their 2027 plan documents and previously distributed notices accurately reflect their arrangement.

Lirvion provides CHOICE Arrangement (ICHRA) administration infrastructure designed to help employers and benefits professionals coordinate these activities.

Our platform and service model support employee enrollment coordination, coverage verification, premium payment workflows, payment status visibility, reconciliation support, and ongoing administration.

The aim is to give employers and brokers clearer visibility into coverage and administrative information as employees transition into a new plan year.

Final Thoughts

The 2027 renewal season presents a combination of proposed premium increases, announced insurer exits, changes in federal financial assistance, and updated affordability requirements.

For employers already offering an ICHRA, these developments make accurate policy information and timely administrative coordination particularly valuable.

A successful renewal means knowing which employees have qualifying coverage, which policies are effective, what premiums are due, and whether the administration records are ready for January.

Addressing those questions before the new year can reduce avoidable payment errors, coverage discrepancies, and employee confusion.
